1. About these Terms

This website is operated by MICHELLE KEPPLER ABN 25426591896, trading as Victorian Goddess (“Victorian Goddess”, “we”, “us” or “our”).
These Terms of Service (“Terms”) apply when you:
  • access or use victoriangoddess.com.au (the “Site”);
  • create a customer or wholesale account;
  • purchase products, digital materials or services from us;
  • book a tarot reading, event or other offering;
  • submit content, feedback or other information through the Site.
By using the Site or placing an order, you agree to these Terms and the policies referenced in them. If you do not agree, please do not use the Site or place an order.
If you use the Site or place an order on behalf of a business or another organisation, you confirm that you have authority to bind that organisation to these Terms.
Nothing in these Terms excludes, restricts or modifies any rights or remedies that cannot lawfully be excluded, including rights under the Australian Consumer Law.

2. Eligibility

You must be at least 18 years old to place an order or create an account through the Site.
By placing an order, you confirm that:
  • the information you provide is complete and accurate;
  • you are authorised to use the chosen payment method;
  • you are legally able to enter into the transaction;
  • your purchase and intended use of the products or services are lawful.

3. Acceptable use of the Site

You must not use the Site:
  • for an unlawful or fraudulent purpose;
  • to infringe another person’s intellectual-property, privacy or other legal rights;
  • to submit false, misleading, abusive, defamatory or discriminatory content;
  • to transmit viruses, malware or harmful code;
  • to interfere with the security or operation of the Site;
  • to gain unauthorised access to accounts, systems or data;
  • to collect personal information about others without lawful authority;
  • to scrape, copy or commercially exploit Site content without written permission;
  • to impersonate another person or misrepresent your identity.
We may restrict or suspend access when reasonably necessary to protect Victorian Goddess, our customers, other users or the security and operation of the Site.

4. Accounts

You may be able to create a customer or wholesale account.
You are responsible for:
  • keeping your login information confidential;
  • activity carried out through your account;
  • providing accurate and current information;
  • notifying us promptly if you believe your account has been accessed without permission.
We may suspend or close an account where we reasonably believe it is being used unlawfully, fraudulently or in breach of these Terms.
You may request account closure by contacting us. We may retain transaction and related information where required for legal, accounting, fraud-prevention or other legitimate business purposes, as explained in our Privacy Policy.

5. Products and availability

Products and services may be available in limited quantities. Availability can change without notice.
We may introduce, change or discontinue products or services. Changes will not affect orders we have already accepted, except where reasonably necessary because a product has become unavailable or an error must be corrected.
If an ordered product becomes unavailable, we will contact you and offer an appropriate option, which may include:
  • waiting for restock;
  • selecting a suitable alternative;
  • receiving store credit;
  • receiving a refund for the unavailable item.
Any alternative will be provided with your agreement.
We may place reasonable limits on purchase quantities where necessary to manage limited stock, prevent fraud or distinguish retail orders from wholesale purchasing.

6. Handmade and natural products

Many Victorian Goddess products are handcrafted in small batches or contain natural ingredients and materials.
Minor variations may occur in:
  • colour, shape, texture or finish;
  • crystal and gemstone appearance;
  • botanical ingredients;
  • fragrance appearance or intensity;
  • labels, vessels and packaging;
  • the placement or appearance of decorative elements.
These natural or handmade variations contribute to the individuality of a product and are not necessarily faults. However, this does not affect your rights if a product is significantly different from its description, unsafe, faulty or otherwise fails to meet a consumer guarantee.
We aim to display product images and colours accurately, but differences may arise because of lighting, photography and device-screen settings.

7. Product descriptions and information

We take reasonable care to ensure that product descriptions, prices, images and availability information are accurate.
If we discover a significant error affecting an order, we will contact you promptly and provide reasonable options. Depending on the circumstances, this may include proceeding with corrected information or cancelling the affected item and issuing a refund.
Nothing in these Terms permits Victorian Goddess to disregard a displayed price or product representation where doing so would breach applicable law.
Information about spiritual, ritual, botanical, crystal or magickal traditions is provided for general educational and spiritual-interest purposes. It is not medical, psychological, legal or financial advice.

8. Prices and payment

Unless stated otherwise:
  • retail prices are displayed in Australian dollars;
  • retail prices include GST where applicable;
  • delivery charges are calculated or displayed during checkout;
  • the total payable amount will be shown before you submit your order.
Wholesale prices and their GST treatment will be displayed through the wholesale area or advised separately.
Prices may change from time to time. A price change will not affect an order already accepted, except where an obvious error has occurred, and applicable law permits correction.
Payment must be made using a method offered at checkout. Payments may be processed by third-party providers such as Shopify Payments, Shop Pay, Afterpay, or other available payment services.
Your use of a third-party payment service may also be governed by that provider’s terms and privacy policy.

9. Orders and acceptance

Submitting an order is an offer to purchase the selected products or services.
An automated order confirmation email acknowledges receipt of your order. It does not necessarily mean that the order has been accepted.
An order is accepted when we:
  • confirm dispatch of physical products;
  • confirm a service booking;
  • provide access to a digital product;
  • otherwise expressly confirm acceptance.
Before acceptance, we may decline or cancel an order for a reasonable reason, including:
  • an item becoming unavailable;
  • an obvious pricing or product-information error;
  • unsuccessful or unauthorised payment;
  • suspected fraud or unlawful activity;
  • incorrect delivery information that cannot be resolved;
  • retail purchasing that appears intended for unauthorised commercial resale.
If we cancel an order after payment has been taken, we will refund the affected amount to the original payment method as soon as reasonably practicable.

10. Order changes and cancellations

If you need to change or cancel an order, contact us as soon as possible.
We will try to assist, but changes or cancellations cannot be guaranteed after an order has been packed, dispatched, digitally supplied or a service has begun.
Once a physical order has been dispatched, any return is handled in accordance with our Returns, Refunds and Exchanges Policy.
This section does not affect your rights under the Australian Consumer Law.

11. Retail shipping

Victorian Goddess currently ships within Australia only.
Retail dispatch timeframes, delivery charges, free-shipping thresholds, tracking and delayed-parcel procedures are explained in our Shipping Policy.
Delivery dates are estimates unless we expressly state otherwise. Postal and courier delays can occur, particularly for regional and remote destinations.
If a parcel is substantially delayed, missing or damaged, contact us so that we can investigate and provide an appropriate response.

12. Wholesale orders

Wholesale purchasing is available to approved wholesale customers and may be subject to additional wholesale terms, pricing, minimum orders or account requirements.
Wholesale customers must select Wholesale Shipping at checkout. Retail shipping rates and retail free-shipping thresholds do not apply to wholesale orders.
Current wholesale shipping thresholds and charges are set out in our Shipping Policy.
Wholesale products are purchased for legitimate business resale. You must not:
  • misrepresent yourself as an authorised Victorian Goddess representative;
  • alter or remove Victorian Goddess branding misleadingly;
  • make false or unapproved claims about our products;
  • use our intellectual property outside the reasonable promotion and resale of genuine products without permission.
If a separate written wholesale agreement applies, that agreement will prevail to the extent of any inconsistency with these Terms.

13. Returns, refunds and exchanges

Returns, refunds and exchanges are governed by our Returns, Refunds and Exchanges Policy.
Our voluntary change-of-mind policy operates in addition to—not instead of—rights available under the Australian Consumer Law.
Sale and clearance items may be excluded from change-of-mind returns, but they remain protected by applicable consumer guarantees.

14. Gift cards and promotions

Gift cards:
  • may be used only in accordance with the conditions provided at purchase;
  • cannot generally be redeemed for cash except where required by law;
  • should be treated like cash, and customers are responsible for keeping gift-card information secure.
Promotional offers may be subject to specific eligibility requirements, dates, product exclusions and usage limits. These conditions will be stated with the relevant offer.
Discounts cannot be combined unless expressly permitted.
We may correct, suspend, or withdraw a promotion if there is an error, fraud, misuse, or a circumstance that makes continuation unreasonable, subject to applicable law and without affecting completed eligible purchases.

15. Tarot readings and spiritual services

Tarot readings and other spiritual services are intended to support personal reflection, insight and spiritual exploration.
They are not a substitute for professional:
  • medical or mental-health care;
  • legal advice;
  • financial advice;
  • emergency assistance.
We do not guarantee a particular prediction, outcome, personal result or experience from a tarot reading, ritual product or spiritual service.
You remain responsible for your own decisions and actions. If you require medical, psychological, legal or financial assistance, seek advice from an appropriately qualified professional.
You may choose what personal information to share during a reading. Information provided for a reading will be handled in accordance with our Privacy Policy.
Any service-specific delivery, rescheduling or cancellation conditions displayed on the relevant service page will also apply.

16. Product use and safety

You must read and follow all product labels, warnings, care instructions and safety information.
Unless a product is specifically labelled otherwise:
  • products are for external or ritual use only;
  • herbs, flowers, resins, oils and similar products are not intended for consumption;
  • products should be kept away from children and animals;
  • candles, incense and burning products must never be left unattended;
  • burning products must be kept away from flammable materials, drafts and unstable surfaces;
  • Skincare, fragrance or botanical products should be discontinued if irritation occurs.
Natural ingredients can cause allergic reactions or sensitivities. Review product information carefully and seek appropriate professional advice if you have concerns about using a product.
Victorian Goddess is not responsible for harm caused by unlawful use, deliberate misuse or failure to follow clear safety and care instructions. This does not exclude liability that cannot lawfully be excluded.

17. Intellectual property

Unless otherwise stated, the Site and its content—including text, photographs, graphics, logos, product names, designs, downloads and course materials—are owned by or licensed to Victorian Goddess and are protected by intellectual-property laws.
You may access and use the Site for personal shopping and information purposes.
Without written permission, you must not:
  • reproduce, publish, distribute or commercially exploit our content;
  • copy product descriptions or photographs for another business;
  • modify or create derivative works from our materials;
  • use our name, branding or content in a way that suggests endorsement or affiliation;
  • remove copyright, trade-mark or ownership notices.
Approved wholesale customers may use authorised product images and descriptions solely to promote genuine Victorian Goddess products, subject to any wholesale brand requirements.

18. Reviews, feedback and submissions

If you submit a product review, testimonial, photograph, comment or other content, you confirm that:
  • it reflects your genuine experience or opinion;
  • it is accurate to the best of your knowledge;
  • you have the right to submit it;
  • it does not infringe another person’s rights;
  • it is not unlawful, abusive, defamatory, misleading or malicious.
You retain ownership of your content. You grant Victorian Goddess a non-exclusive, royalty-free licence to display, reproduce and adapt that content for operating and promoting Victorian Goddess, subject to applicable privacy laws.
We will not publish personal correspondence, photographs or testimonials for promotional purposes without appropriate permission.
We may moderate or remove content that is unlawful, fraudulent, irrelevant, offensive or inconsistent with these Terms. We will not suppress or manipulate genuine reviews merely because they are negative.

19. Third-party services and links

The Site may contain third-party services, applications, payment options or links.
We do not control third-party websites and are not responsible for their independent content, availability, security or privacy practices.
When you choose to use a third-party service, your use may be governed by that provider’s terms. Review those terms before proceeding.
This does not exclude any responsibility Victorian Goddess has under applicable law for services we have selected to fulfil our obligations to you.

20. Privacy

Our collection, use, storage and disclosure of personal information are explained in our Privacy Policy.
By using the Site, you acknowledge that your personal information may be processed by Shopify and other service providers involved in payments, delivery, analytics, marketing and operation of the Site.

21. Website availability

We aim to keep the Site available and secure, but continuous or error-free access cannot be guaranteed.
We may temporarily restrict access to perform maintenance, respond to security issues or make improvements.
Temporary Site unavailability does not affect orders already accepted or any rights you have under applicable law.

22. Liability

Nothing in these Terms excludes, restricts or modifies:
  • consumer guarantees under the Australian Consumer Law;
  • liability for fraud, wilful misconduct or negligence where it cannot lawfully be excluded;
  • any other right, remedy or liability that cannot be excluded by agreement.
To the extent permitted by law, Victorian Goddess is not responsible for loss caused solely by:
  • unlawful or unintended use of a product;
  • failure to follow clear product instructions or safety warnings;
  • unauthorised access resulting from your failure to protect account credentials;
  • an independent third-party website or service that you choose to use;
  • events outside our reasonable control that we could not reasonably prevent.
If an event outside our reasonable control delays an accepted order, we will provide clear information and work with you toward an appropriate solution.

23. Suspension and termination

You may stop using the Site at any time.
We may suspend or terminate access where reasonably necessary because of:
  • a serious or repeated breach of these Terms;
  • fraud, abuse or unlawful conduct;
  • threats to Site security or other users;
  • a legal or regulatory requirement.
Termination does not affect rights and obligations that arose before termination, including payment obligations, accepted orders, intellectual-property rights and dispute-resolution rights.

24. Changes to these Terms

We may update these Terms to reflect changes in our business, services, technology or legal obligations.
Updated Terms will be published on the Site with a revised date. Changes will apply prospectively to future Site use and orders and will not retrospectively alter an order already accepted unless required by law or agreed with you.

25. Governing law

The laws of New South Wales and the Commonwealth of Australia govern these Terms.
The courts of New South Wales and any courts entitled to hear appeals from them have non-exclusive jurisdiction, subject to any rights you may have to bring a claim elsewhere under applicable consumer law.

26. General provisions

If part of these Terms is found to be invalid or unenforceable, it will be read down where possible or severed to the minimum extent necessary. The remaining provisions will continue to operate.
A failure or delay in exercising a right does not waive that right.
These Terms, together with the policies and additional conditions expressly referenced in them, form the agreement governing your use of the Site and purchases from Victorian Goddess.
